Monthly Game Review Contest
Official Rules
Please read these Official Rules before entering the VGViews.com Monthly Game Review Contest (the “Contest”). By entering this Contest, entrants agree to be bound by these Official Rules (“Rules”).
  • REVIEW Contest. This is a SKILL CONTEST (not a random drawing). winners will be DETERMINED FROM ALL valid ENTRIES BASED on THE objective criteria set forth herein below.
  • There is NO ENTRY FEE and there is NO PURCHASE NECESSARY. A purchase does not provide any chance of winning.
  • Eligibility. This Contest is open to legal residents of the 50 United States and the District of Colombia who are thirteen (13) years of age or older as of the date of entry. Entrants who do not meet these eligibility requirements and/or whose entries do not comply with all provisions of these Rules will not be eligible to win a prize.
    • Ineligible Persons: Employees, contractors, officers and directors and their immediate family members of VGViews Inc. (“Sponsor”), prize suppliers, their advertising or promotion agencies, subsidiaries or affiliates, agents or agencies, are not eligible to enter and win this Contest.
    • This Contest is void and not offered where prohibited by law.
  • Contest Period. The Contest runs monthly commencing on February 1, 2008 and ending on April 31, 2008 (the “contest period”).
  • How to Enter the Contest. Eligible persons only (see above) may enter this Contest electronically by correctly completing and submitting the requested information on the Official entry page at www.vgviews.com pursuant to these Official Rules and the instructions set forth on the entry page, which are hereby incorporated by reference as though fully set forth herein.
    • All game review entries must be submitted in the English language.
    • There is a limit of 1,000 words per game review entry.
    • During the contest period, all game review entries must be submitted from 12:00 a.m. on the first day of the month to 11:59 p.m. on the last day of the month to win the prize offered for that month. All times are Pacific Coast Time (USA).
    • No multiple game review entries for any one game. Multiple individual and separate game review entries, per person, per month, are permitted.
    • No group entries are permitted.
    • No single entry with a review by two or more persons is permitted.
    • Electronic entries only.
    • All entries not received in accordance with this section are invalid and void.
  • Original Work of Authorship. By submitting a game review entry, you (and your parents or legal guardians, if you are a minor) represent and warrant that your game review is wholly your original work of authorship and does not incorporate or include anything that is owned by any third party or would require the consent or permission of any third party and your story does not violate any copyright, trademark, publicity right, privacy right or other intellectual property right of any third party.
  • Ownership of Entries and Unrestricted Use of Entries by Sponsor.
    • VGI does not claim ownership of individual game review entries.
    • VGI claims sole ownership all right, title and interest in the compilations of all game review entries, including all derivatives thereof, and all copyrights pertaining thereto. Accordingly, all compilations of all game review entries, including all derivatives thereof, and all copyrights pertaining thereto shall be the sole property of VGI, its successors and assigns, and you hereby assign and transfer to VGI all right, title and interest that You may have or acquire in any compilation of game review entries, including without limitation, all derivatives thereof, and all copyrights pertaining thereto. You agree to execute and provided any such further documents, testimony and evidence as VGI may reasonably require to perfect, evidence, record or register VGI’s sole ownership of property and rights as set forth herein.
    • By uploading, posting, publishing or displaying game review entries to the Site, You grant to VGI and its successors and assigns an irrevocable, perpetual, non-exclusive, transferable, royalty free, worldwide right and license to commercially exploit the game review entries, including the right and license to store, use, reproduce, digitally perform, publicly perform, publicly display, publish, modify, adapt, reformat, translate, excerpt (in whole or in part), prepare derivative works, compilations and databases, of game review entries, and to distribute or transmit any of the aforesaid in any media, now known or hereafter devised, and to grant and authorize sublicenses of the foregoing, in whole or in part, all without monetary payment or other consideration of any kind to You, your heir or any third party.
    • Entrant reserves no right and releases any and all rights it may have, individually or collectively, to claim or disclaim authorship of the game review entries, prevent or demand the use of entrant’s name as author of the game review entries, prevent or demand any modification of the game review entries which may be prejudicial to honor or reputation, and to prevent or demand destruction of the game review entries.
    • Entrant acknowledges that this provision gives Sponsor the right to use or to grant others the right to use each entrant’s game reviews online or in any other way as Sponsor may decide in its sole and absolute discretion, in any media or medium, now known or hereinafter invented, without notice or compensation of any kind to entrant, even if the entrant is not awarded any prize.
  • Selection of Winners and Prizes. For each month during the contest period, prizewinners will be determined from all valid entries received for the respective month. Prizewinners will be determined solely at the discretion of Sponsor. All decisions of Sponsor are final and binding. All valid game review entries will be judged on the below listed criteria and awarded merit points within the ranges stated for each criteria (“0” points representing no merit and the maximum number of possible points representing the highest merit).

    Game Presentation: describe the design and presentation of the game.

    Game Play: describe how appealing the game play is and how difficult and/or frustrating it is, include how many times you played it and for how long you played it to reach these opinions. 
    0 – 20
    Score the Game: Based on your review of the game using the above described criteria, score the game on a scale of 0 to 100 (“0” representing a low score (i.e., not recommended) and 100 representing the highest score (highly recommended).
    0 - 15
    Creative Writing: your review will be scored based on creative writing style and entertainment value.
    0 - 15

    The game review entry receiving the highest number of the 100 total possible points will qualify the entrant to receive the Monthly Prize offered during the month in which the entries were received.
    There will be no ties. If two or more entries are awarded an equal number of merit points and the total number of points awarded are amongst the highest entries eligible to receive a prize, the entries receiving the equal award of points will be re-judged by Sponsor relative to each other based upon the same criteria and merit point system until there are no longer two or more entries receiving an equal award of points. The award of merit points is the proprietary and confidential information of Sponsor for the internal use of Sponsor only in the determination of the winners of a prize in this Contest. Except as may be required by law, Sponsor will NOT disclose the number of merit points awarded any entry to anyone outside of Sponsor and its affiliates, representatives and agents having a need to know the information for the proper administration and management of this Contest.
    • Monthly Prizes: Each monthly prize and approximate retail value will be announced (displayed) on www.vgviews.com on or before the 1st day of the month in which the prize will be eligible for award.
  • Odds of Winning. The odds of winning a prize depend on the relative skill of each entrant among all valid entries received for each month during the contest period.
  • Notification of Winners. All winners will be notified via email or telephone (at Sponsor’s sole discretion) within thirty (30) days after the end of each month during the contest period as soon thereafter as commercially reasonable. In addition, at the same time or soon thereafter as commercially reasonable, all prize winners’ names, address (city and state) and prize information will be posted on Sponsor’s web site.
  • Acceptance of Prizes. All winners of a prize (if the winner is a minor, then the minor’s parent or guardian) must complete, sign and return to Sponsor a Prize Notification and Acceptance, Affidavit of Eligibility, Publicity Release and Liability Waiver within five (5) days of notification to accept the prize.
  • Delivery of Prizes. Subject to the terms and conditions of this Contest for acceptance of prizes by prize winners, prizes will be shipped to the address on the winner’s entry as soon as commercially reasonable after the prize has been accepted.
  • Forfeiture of Prize. Noncompliance with these Official Rules, or if a prize winner cannot be reached at the contact information provided on the winner’s entry, or if a prize or prize notification is returned as unclaimed, refused or undeliverable for any reason beyond the control of Sponsor, that prize will be forfeited for all time and may not be claimed or reclaimed by the prior identified winner at any time. Sponsor reserves the right, in its sole discretion, to award a forfeited prize to an alternate winner based on the objective criteria set forth herein or in a separate contest under its own official rules. No winner shall be eligible to win more than one prize. Nothing herein shall require or otherwise obligate Sponsor to award any prize that has been forfeited for any reason, at any time, to any party.
  • Transfers/Substitutions. Winners may not transfer prizes. No substitutions will be permitted except that Sponsor reserves the right in its sole discretion to substitute a prize of equal of greater value, as deemed necessary and appropriate by Sponsor.
  • Taxes/Fees. All taxes, fees and surcharges on prizes are the sole responsibility of each prizewinner (or the prize winner’s parent or legal guardian, if the winner is a minor).
  • ENTER AT YOUR OWN RISK / RELEASE OF LIABILITY.
    BY ENTERING THIS CONTEST, YOU (AND, IF YOU ARE A MINOR, YOUR PARENTS OR LEGAL GUARDIANS) ACCEPT ALL RISK AND CONSEQUENCES OF ENTRY AND PARTICIPATION IN THIS CONTEST AND AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, PRIZE SUPPLIERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES, AGENTS, SUCCESSORS AND ASSIGNS FROM ANY AND ALL CONSEQUENCES, LIABILITY, LOSSES, DAMAGES (INCLUDING WITHOUT LIMITATION, CONSEQUENTIAL, PUNITIVE, INCIDENTAL, SPECIAL OR INCREASED DAMAGES AND THOSE RELATED TO PERSONAL INJURY, DEATH OR DAMAGE TO PROPERTY) AND COSTS AND EXPENSES, OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING FROM OR RELATED TO THIS CONTEST, INCLUDING BUT LIMITED TO YOUR ENTRY AND PARTICIPATION IN THE CONTEST, THE ACCEPTANCE AND/OR USE (OR MISUSE) OF ANY PRIZE, THE PARTICIPATION IN ANY TRIP OR TRIP RELATED ACTIVITY, ANY DELAY, INTERRUPTION, EARLY TERMINATION OR FORFEITURE, IN WHOLE OR IN PART, OF ANY PRIZE TRIP OR RELATED TRAVEL, LODGING OR TRIP RELATED ACTIVITY (BEFORE, DURING OR AFTER), EVEN IF SPONSOR OR ANY OF THE OTHER RELEASED PARTIES WERE AWARE OF THE POSSIBILITY OF ANY SUCH CONSEQUENCES, LOSSES, DAMAGES, ETC.
    WITHOUT LIMITING THE FOREGOING, YOU (AND, IF YOU ARE A MINOR, YOUR PARENTS OR LEGAL GUARDIANS) FURTHER AGREE THAT NEITHER SPONSOR NOT ITS AFFILIATES, PRIZE SUPPLIERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES, AGENTS, SUCCESSORS AND ASSIGNS, SHALL BE LIABLE FOR ANY DAMAGES, LOSSES, COSTS OR EXPENSES, OF ANY KIND, ARISING FROM OR RELATED TO CIRCUMSTANCES BEYOND THE REASONABLE CONTROL OF SPONSOR, ITS AFFILIATES, PRIZE SUPPLIERS, AND THEIR RESPECTIVE REPRESENTATIVES AND AGENTS, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, ACTS OF GOVERNMENT, ACTS OF TERROR, ACTS OF WAR, CIVIL UNREST, LABOR SHORTAGES AND/OR STRIKES, EVEN IF SPONSOR OR ANY OF THE OTHER PARTIES WERE AWARE OF THE POSSIBILITY OF ANY SUCH EVENTS OCCURRING.
  • INDEMNIFICATION. BY ENTERING THIS CONTEST, YOU (AND, IF YOU ARE A MINOR, YOUR PARENTS OR LEGAL GUARDIANS) AGREE TO INDEMNIFY AND HOLD HARMLESS SPONSOR AND ITS AFFILIATES, PRIZE SUPPLIERS, AND THEIR RESPECTIVE REPRESENTATIVES AND AGENTS FROM AND AGAINST ANY AND ALL DAMAGES AND EXPENSES OF ANY KIND (INCLUDING REASONABLE ATTORNEYS’ FEES, COSTS AND LITIGATION EXPENSES) INCURRED BY SPONSOR AND ANY OTHER INDEMNIFIED PARTY ARISING OUT OF ANY CAUSE OR ACTION RELATED TO THE ENTRY OR PARTICIPATION IN THIS CONTEST BY YOU, THE ACCEPTANCE AND USE OF ANY PRIZE BY YOU, AND/OR THE REPRODUCTION, USE, PUBLICATION, DISPLAY, DISTRIBUTION OR OTHER COMMERCIAL OR NON-COMMERCIAL USE OF THE CONTENT (IN WHOLE OR IN PART) OF ANY ENTRY AND/OR STORY SUBMITTED BY YOU TO SPONSOR.
  • Use of Entrant’s Name, Likeness, etc. By entry into this Contest, each entrant grants Sponsor and its agents the right to use the entrant’s name, photograph, likeness, address (city and state) and/or prize information, without limitation, in connection with the reproduction, publication and display of Entries in printed or electronic media or mediums, now known or hereinafter invented, in connection with the advertising and promotion of Sponsor’s business, it’s goods and services, and the winners list, without further permission or additional compensation of any kind to entrant, even if the entrant is not awarded any prize. Except as required by law, nothing herein shall require or obligate Sponsor to use (in any way) or disclose any entrant’s Entries or name, photograph, likeness, etc., for any reason.
  • Contest Information. For a list of winners, visit www.vgviews.com as may be periodically posted thereon during the contest period and thereafter for a limited period of time or send a stamped, self-addressed envelope to Sponsor at the address listed below, marked, Attn: Winners List, VGViews.com Monthly Game Review Contest. Residents of WA and VT may omit return postage.
  • Miscellaneous. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Contest or any entrant’s participation in the Contest at any time, in its sole discretion, including if viruses, bugs, unauthorized human intervention or other causes beyond Sponsor’s control affect the administration, security or proper play of the Contest. Entrants who violate these Official Rules, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant (in each case as determined in Sponsor’s sole discretion) are subject to disqualification from entry in the Contest. Sponsor reserves the right to disqualify any entrant whose eligibility is in question.   • Governing Law / Jurisdiction. This Contest is governed by the laws of the State of California without application of conflict of law principles. By entering and participating in this Contest, you (your parent or legal guardian, if you are a minor) agree that any and all disputes arising from or related to this Contest shall be resolved between you (your parent or legal guardian, if you are a minor) and Sponsor, individually, without resort to any form of class action, and any and all legal actions shall be brought in a court of competent jurisdiction residing in San Mateo County, California.
  • Sponsor. The Sponsor of the Contest is VGViews Inc.
